HARRISBURG, Pa. - On Dec. 8, the Pennsylvania Supreme Court is due to hear arguments over the legality of the state health department’s school mask mandate.
The case has made its way to the state’s highest court after being thrown out by a Commonwealth Court decision in November.
“The Commonwealth Court heard arguments on that (the school mask mandate) and issued their order in November, where they said, from the very beginning, this department of health order was not valid. It should have been done in a different way. There were procedural things they did incorrectly so that it can't be enforced,” said Rebecca Young, an attorney and partner at the law firm of King Spry Herman Freund & Faul in Bethlehem.
Young explained that now, the Supreme Court will hear arguments on both sides of the case and come to a decision of its own on the legality of the health department’s order.
“They're not bound by any legal conclusions the Commonwealth Court made,” Young said.
